This is the type of unthinking that happens far too much around dealing with the law: "Oh sh*t I have something new that I don't know how to pigeonhole. I'll pass the buck to someone else." On a continuity issue: I thought we were lead from the previous scenes to think that Kretz had his hearing first since he was taken from the cell first and the judge appeared to have already heard it when she was talking to Howard.
